Who you can claim from
1. NZTA Waka Kotahi (state highway potholes)
If you damaged your car on a pothole on a state highway (SH1, SH2 etc), NZTA is the road controlling authority. NZTA has a duty of care under the Land Transport Management Act and common-law negligence principles.
Submit at: nzta.govt.nz claims for damage
Time limit: 6 years (NZ Limitation Act) but practically claim within 3 months for best outcome
Required: GPS location, photos of pothole + damage, repair invoice or quote, vehicle registration
2. Your local council (urban/rural local roads)
Every NZ council has a similar duty of care. Some have published claim portals; others require a written letter to the council CE. Auckland Transport, Christchurch City Council, Wellington City Council, and Hamilton City Council all accept road damage claims via their service request systems.
3. Your motor insurer
Comprehensive insurance in NZ usually covers pothole damage as a single-vehicle accident, subject to your excess. Third-party-only policies don't. The catch: a claim affects your no-claims bonus and may push your renewal premium up. For damage under NZ$1,500, claiming from the road authority directly is often better even though it's slower.
What evidence wins a claim
Photo of the pothole BEFORE you'd think to take one — turn on dashcam if you have one, otherwise pull over safely and photograph the pothole with a coin or shoe for scale
GPS coordinates (Google Maps long-press → 'Share location' → save the lat/lng)
Photo of the damage to your vehicle, taken the same day
Independent repair invoice (not just a quote — actually do the repair, then submit)
Police log if you stopped (109 non-emergency or 111 if dangerous)
Most importantly: a copy of any prior pothole reports for that exact location — councils and NZTA must show they responded within reasonable time. A 3-month-old report = strong claim
What gets denied
No photo of the pothole — denied 90% of the time
No GPS coordinates — they need to verify which road authority is responsible
Claimed more than 12 months after the damage — 'unreasonable delay'
Driving above the posted speed for the conditions — contributory negligence
Pothole was reported less than 24 hours before — insufficient response time

Common questions
Can I claim from NZTA if I hit a pothole on a state highway at night?
Yes, but NZTA may argue contributory negligence if your headlights were dipped or you were over the speed limit. The claim is more likely to succeed if you stayed under the limit and the pothole was unmarked at the time.
